How to File a DMCA Takedown Notice
If you believe content on ProteinPicked infringes your copyright, please contact us with a written notice.
Your Notice Must Include:
- Your contact information: Full name, mailing address, phone number, and email address.
- Description of copyrighted work: A description of the copyrighted work you claim has been infringed.
- URL of infringing content: The specific URL(s) on our site where the allegedly infringing content is located.
- Statement of good faith belief: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- Statement under penalty of perjury: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
- Your signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Our Response
Upon receiving a valid DMCA takedown notice, we will:
- Acknowledge receipt within 48 hours.
- Review the claim and, if valid, remove or disable access to the infringing content promptly.
- Notify the content provider (if applicable) so they may file a counter-notification.
Counter-Notification
If you believe your content was removed in error, you may file a counter-notification containing:
- Your name, address, phone number, and email address.
- Identification of the material that was removed and its original location.
- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification.
- A statement consenting to the jurisdiction of the federal court in your district (or, if outside the US, any judicial district in which we may be found).
- Your physical or electronic signature.
Repeat Infringers
In accordance with the DMCA, we will terminate access for users who are repeat copyright infringers in appropriate circumstances.
Good Faith Claims
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.
